Article 200 of the Constitution

The Supreme Court has raised the question of whether a Governor can reserve a Bill for the President under Article 200 after already withholding assent.

About Article 200:
Once a Bill is passed by the State Legislature, the Governor has the authority to:

  • Give assent to the Bill
  • Withhold assent
  • Reserve the Bill for the President’s consideration

Returning a Bill: If the Bill is not a Money Bill, the Governor can return it with recommendations. However, if the Bill is passed again by the legislature, the Governor must give assent.

Reservation for the President: If a Bill impacts the powers of the High Court, the Governor is required to send it to the President for approval.
