TDSAT
The Telecom Disputes Settlement & Appellate Tribunal (TDSAT) recently stayed the penalties imposed by the Telecom Regulatory Authority of India (TRAI) on telecom companies for failing to control spam.
About TDSAT:
Establishment: TDSAT is a statutory body created by an amendment to the TRAI Act, 1997, in 2000.
Function: Its primary role is to adjudicate disputes, address appeals, and safeguard the interests of both service providers and consumers.
Composition: The tribunal is made up of a Chairperson and two Members, all appointed by the Central Government.
Powers and Jurisdiction:
- TDSAT has both original and appellate jurisdiction over telecom, broadcasting, and airport tariff matters.
- It holds appellate jurisdiction in matters related to cyber (IT) issues.
Guiding Principles: The tribunal operates under the Principles of Natural Justice and has the authority to regulate its own procedures.
