The United States President Signed an Executive Order to End Birthright Citizenship

The U.S. President Signs Executive Order to End Birthright Citizenship

The U.S. President recently signed an executive order aimed at ending birthright citizenship, which would revoke automatic citizenship for children born in the U.S. regardless of their parents' immigration status. However, a federal judge has temporarily blocked this order.

About Birthright Citizenship in the U.S.:

  • Definition: Birthright citizenship is a provision under the 14th Amendment (1868) of the U.S. Constitution that grants automatic citizenship to anyone born on U.S. soil.
  • Historical Context: This provision was upheld by the U.S. Supreme Court in United States v. Wong Kim Ark (1898), applying to children born to non-citizen parents.

Implications for India with the End of U.S. Birthright Citizenship:

  • H-1B Visa Holders: Children born to Indian professionals on H-1B visas or those awaiting Green Cards will no longer automatically qualify for U.S. citizenship.
  • H-1B Visa: A temporary visa that allows U.S. employers to hire foreign professionals for jobs that require at least a bachelor’s degree.
  • Temporary Visa Holders: Indian students and families on temporary visas, one of the largest groups of international students in the U.S., will face challenges in securing U.S. citizenship for their children born there.
  • Impact on Immigration: This policy could discourage Indian professionals, students, and others from migrating to the U.S., driving them toward more immigration-friendly countries like Canada and Australia.
  • Curbing "Birth Tourism": The policy also aims to reduce the practice of "birth tourism," where women travel to the U.S. specifically to give birth, enabling their children to claim U.S. citizenship.
