Domicile-based Reservation
The Supreme Court recently ruled that domicile-based reservations for Postgraduate (PG) medical seats are unconstitutional, as they violate Article 14 of the Constitution, which guarantees equality before the law.
Constitutional Provisions for Domicile-based Reservations:
- Article 16 (2): This provision states that no citizen shall be ineligible for or discriminated against in any employment or office under the State solely on the grounds of religion, race, caste, sex, descent, place of birth, residence, or any combination thereof.
- Article 16 (3): However, this article allows Parliament to legislate on the requirement of residence within a State or Union Territory (UT) for specific classes of employment under the State/UT government or local authority.
